Terms of service.

These terms are the agreement between you and FRKLIN TECH for using Sell it better. Plain English, no surprises: if anything here is unclear, write to us before you buy.

1. Who we are

Sell it better is run by FRKLIN TECH, Via Paolo Bellezza 18, Roma, C.F. PLNFNC99M10H501B. You can reach us at francescopalandra@icloud.com. When these terms say “we” or “us”, that is who they mean.

2. What the service does

You upload photos of an item you want to sell and tell us what it is. We return the same item photographed as if in a studio, with new lighting, background and surface, together with an indication of what comparable items are currently listed for on eBay. These are asking prices from live listings, not sale prices, and they are an estimate rather than a valuation.

The object itself is never retouched: a scratch in your photo is a scratch in the result. Results are generated by AI models. They vary, and you should look at every image before you publish it.

3. Your account

You need an account to buy and spend tokens. Keep your password to yourself, give us a working email address, and tell us if you think someone else is using your account. You must be at least 18, or have the permission of a parent or guardian. One person, one account: the free sign-up token is for new customers, not for repeat sign-ups.

4. Tokens

  • One token is one finished studio photo, with the marketplace price check included.
  • A photo that fails to render is refunded to your balance automatically, normally within minutes.
  • Tokens do not expire.
  • Tokens are personal. They cannot be transferred or sold, and cannot be exchanged for money except as described in the Refund policy.
  • Your balance, and every token in and out, is shown under Tokens & billing.

5. Prices, payment and invoices

Prices are in euros. No VAT is charged: the seller is a private individual and these sales fall outside the scope of Italian VAT (art. 5 DPR 633/72). The price on the card is what you pay, and the invoice says so. Payments are handled by Stripe. We never see or store your card details.

You receive a numbered invoice for every purchase by email, and can open it at any time under Tokens & billing. We may change prices; tokens you already hold are never affected.

6. Right of withdrawal and refunds

If you are a consumer in the EU, you normally have 14 days to withdraw from an online purchase. Tokens are digital content delivered immediately: by paying, you ask us to deliver them at once and acknowledge that, once you use tokens from a pack, you lose the right of withdrawal for that pack.

Until then you can still get the pack refunded, from Tokens & billing, within 14 days, as long as your balance still holds all of its tokens. The Refund policy describes this, including what happens to tokens when money is refunded.

7. What you may not do

  • Upload photos you do not have the right to use, or photos of people without their consent.
  • Upload or request unlawful, sexual, violent or hateful content.
  • Use the service to mislead buyers about an item's condition.
  • Try to break, overload or reverse-engineer the service, or buy tokens with a payment method that is not yours.

We may refuse or stop renders that break these rules; tokens for refused renders go back to your balance. Repeated abuse can close the account.

8. Your photos and the results

Your photos stay yours. You give us permission to process them, including sending them to the AI providers that do the rendering, only to deliver the service. Uploaded photos and results stay on our servers only briefly; your gallery lives in your own browser.

The images we return are yours to use in your listings. You are responsible for what you publish: check that the result still shows the item truthfully.

9. Availability and liability

We run the service with care but cannot promise that it is available at every moment or that every render succeeds. To the extent the law allows, we are not liable for indirect losses such as lost sales, and our total liability towards you is limited to what you paid us in the twelve months before the event. Nothing in these terms limits rights you have as a consumer that cannot be limited by law.

10. Changes and ending

We may update these terms; if a change matters, we tell you by email or on the site before it applies. You can close your account at any time by writing to us. Records of purchases are kept for as long as tax law requires.

11. Law and disputes

Italian law applies. If you are a consumer, you also keep the protection of the mandatory rules of the country you live in, and disputes go to the court of your place of residence. Write to us first: most things are solved by email.
